Were you sold smoke on the tax benefit for your electric car?

You bought an electric vehicle believing that, beyond saving fuel and supporting the energy transition, you could obtain a tax benefit. Then you discovered that the invoice was not enough. Forms, technical documents, certifications, platforms and correction requests followed.

The uncomfortable question is this: is the procedure designed to verify that the benefit is granted correctly, or to exhaust the applicant until they give up?

Buying the vehicle does not guarantee the benefit

Colombia offers tax incentives related to energy efficiency and electric mobility. In general, however, the benefit is not activated automatically by purchasing a vehicle. The path usually includes gathering the vehicle’s technical and commercial documentation, submitting the application through the relevant UPME route, responding to observations within the stated deadlines, obtaining UPME certification where requirements are met, and then pursuing the applicable tax treatment before DIAN.

UPME certification does not necessarily mean that money will be returned automatically. It is an essential step supporting the later application of the incentive. It is therefore important to distinguish three separate moments: buying the vehicle, obtaining certification and effectively applying the tax benefit.

What can an applicant do?

First, correct and complete the application. If the authority raises observations, respond within the time allowed and provide clear, legible and consistent documents. Second, where an application has been rejected or archived and requirements can still be met, consider a new application after understanding the reason for the prior decision. Third, assess the available administrative remedies against an unfavourable decision, especially if it does not explain clearly what requirement was missing or why submitted documents were rejected.

A formal right-to-petition request may also seek information, clarification, copies of the file, the criteria applied and the actual status of the procedure. Where serious failures, unjustified delay or evasive responses occur, a complaint to oversight bodies or the appropriate judicial route may need legal assessment. Not every case becomes litigation; neither should every case end in resignation.

Traceability is the most important evidence

Keep invoices, certificates, technical sheets, emails, filing numbers, screenshots, replies and dates. If a platform fails, document the error. If a system rejects a file without explaining why, preserve the evidence. If the authority requests the same information repeatedly, record each request. Traceability can turn a general complaint into a substantiated claim.

The State is entitled to verify that incentives reach people who satisfy their conditions. What is not acceptable is a procedure so confusing, repetitive or unpredictable that citizens abandon it. Digitalisation should not merely move paperwork to a website; a good platform should identify what is missing, permit corrections and explain why a submission was returned.
